1. Provider and acceptance
Sportive is provided by Christopher Adelmann, trading as Adelmann Labs, c/o Online-Impressum 7259, Europaring 90, 53757 Sankt Augustin, Germany. By creating an account, you agree to these Terms and the incorporated Community Guidelines.
2. Minimum age
You must be at least 16. If you are 16 or 17, you confirm during registration that your guardian has consented. Sportive does not independently verify that consent. Age information must be accurate.
3. Account and profile
- Protect your credentials and report unauthorised access.
- You may use a pseudonym but must not impersonate another person or organisation.
- Profile information and content must be lawful and must not deceive or endanger others.
- You are responsible for activity through your account to the extent attributable to you.
4. Sportive’s role
Sportive is a technical platform for discovering sports places, connecting with members, running clubs, and recording activities. Sportive does not organise or supervise meetups, operate venues, verify identity, or provide emergency services. We do not guarantee the availability, suitability, safety, or accessibility of a place or member.
5. Sport and meetups are your responsibility
- Assess your fitness and use appropriate equipment.
- Follow laws, venue rules, opening hours, and operator instructions.
- Decide whether to meet another person and prefer public places for first meetings.
- For an emergency, call 112 rather than Sportive support.
6. Your content and licence
You retain ownership of your content. You grant us a non-exclusive, worldwide licence, limited to the period and acts necessary to store, technically reproduce, transmit to authorised recipients, and display your content within Sportive for operation, security, moderation, and improvement.
- Promotional use requires separate, voluntary, revocable consent for the individual item.
- Identifiable minors also require guardian consent.
- You confirm you hold the required rights and respect the rights of depicted people.
7. Community rules
The Community Guidelines form part of these Terms. Harassment, hate, threats, doxxing, sexual exploitation, child endangerment, fraud, spam, impersonation, illegal content, malicious reporting, scraping, and attacks on the platform are prohibited.
8. Clubs and administrators
Clubs are independently run by members. Administrators maintain accurate information and rules, provide first-line moderation, address problems, and arrange succession. Sportive retains final authority to enforce platform rules.
9. Moderation and enforcement
We may review, remove, or limit content and restrict account features where necessary to enforce rules, protect others, or meet legal duties. Actions include warnings, removal, feature restrictions, temporary suspension, and permanent suspension. Where appropriate and lawful, we provide the reason and duration. Appeals may be sent to [email protected] within six months and are human-reviewed.
10. Sportive Pro
Subscriptions are offered only through Apple’s App Store. Price, duration, trial, and renewal are shown in Apple’s purchase sheet. Apple handles payment, renewal, cancellation, and applicable refunds. Suspension does not automatically create a refund right; mandatory consumer rights remain unaffected.
11. Prohibited technical use
- No unauthorised scraping, crawling, or bulk extraction of profile, location, or community data.
- No bypassing access controls, limits, App Check, or security mechanisms.
- No malware, phishing, automated account creation, or service disruption.
12. Termination and deletion
You can delete your account in the app. Personal content is deleted or redacted; non-personal shared contributions such as anonymised venue information may remain. We may change or discontinue services with reasonable notice unless urgent safety or legal reasons require faster action.
13. Liability and consumer rights
Liability is unlimited for intent, gross negligence, and injury to life, body, or health. For slight negligence affecting an essential contractual duty, liability is limited to foreseeable, typical damage. Mandatory liability and consumer rights remain unaffected.
14. Law and changes
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods, without limiting mandatory protection in your country of habitual residence. Statutory courts have jurisdiction. Material changes will be announced in-app or electronically before taking effect.
